MINUTES OF MEETING OF OCTOBER 1, 2003, 4:00 P.M., SENIOR CENTER

Meeting called to order under the Wetlands Protection Act and the Wellfleet Environmental Protection Bylaw by Chair Ed Reynolds.
Business Meeting.
- Mail was reviewed.
- The Minutes of the meeting of 9/17/03 were approved, as MOVED by
Moe, SECONDED by Page, and CARRIED 4-0.
Conservation Agent's Report.
- Emily Beebe reported on the meeting with the Open Space/LandBank
Committee, representatives of the ConsComm, Mark Robinson of the
Conservation Trust, and Rex Peterson. Procedural issues were
agreed upon.
- Regulations from other towns concerning use of town-owned land were distributed for review in developing regs for Wellfleet.
- DEP site visit for Brimm Friday, October 17th, 11:00 a.m.
- State of the Harbor Conference Saturday, November 8, Senior Ctr.
- Distributed for review were NRAB's Update, Harbor Management Plan; Memo on Herring River run; Memo on salt marsh restoration. - Jurisdictional Opinion on tree cutting, Callis, 100 E.Main St.
approved, as MOVED by Page, SECONDED by DIBlasio & CARRIED 4-0.
- Certificate of Compliance granted to John Knies, 13 D St.,
Lieut.Isl., as MOVED by Moe, SECONDED by Reynolds, CARRIED 4-0.
- Certificate of Compliance granted to Paul Renaud, Parkington Hill Drive, as MOVED by Moe, SECONDED by Page & CARRIED 4-0.
- Keller's Corner protection plan: It was agreed to go ahead with
sand drift fencing, and trying to get some of the rubble out.
- Wellfl.Bay Wildlife Sanctuary is coordinating free ACEC walks.
- A letter from the CCNS described its program for management of
fresh water ponds. It was agreed that Emily Beebe will ask for
a Request for a Jurisdictional Opinion, which will be reviewed
by Commissioners.
5:00. Harborside Village Cooperative Corporation, RDA, off Kendrick Ave., Map 20, Lot 20: Expand office structure by 4.5 feet. Vi O'Connor represented the corporation, acknowledging that the addition is actually 6 feet, and was done without ConsComm authorization. Commissioners reinforced the message that in future nothing is to be done on this property without prior filing with the Conservation Commission. Cyndi Moe MOVED "that the Conservation Commission make a Determination of Applicability, Negative #2." SECONDED by John DiBlasio and CARRIED 4-0.

5:10. Stephen & Sarah Curley, RDA, 295 Pilgrim Spring Road, Map 29, Lot 242: Apply shell on existing driveway. Mr. Curley said the drainage is good, and applying the shell on top of the existing stone will make for a firm base. Cyndi Moe MOVED "that the Conservation Commission make a Determination of Applicability, Negative #3." SECONDED by Virginia Page and CARRIED 4-0.
5:20. Harvey Geiger, RDA, 155 Baker Road, Map 29, Lot 335: Septic system upgrade. Of three dwellings on this property, two are outside the jurisdiction of the Commission. The cesspool for the cottage is to be removed and a Title 5 system installed in the driveway. Cyndi Moe MOVED "that the Conservation Commission make a Determination of Applicability, Negative #3." SECONDED by Virginia Page and CARRIED 4-0.
5:30. James Rogers, NOI, 45 Springline Drive, Map 29, Lot 256: Garage. (Continued from 9/17/03.) David Lajoie presented a revised plan moving the garage 5-6 feet eastward, away from the marsh. Because of a clump of trees, the idea of moving the driveway has been abandoned. It was clarified that the second story of the garage building will be used for storage only. John DiBlasio MOVED "that the Conservation Commission approve FELCO Plan #03023, as revised 9/19/03, subject to conditions specified." SECONDED by Cyndi Moe and CARRIED 4-0. Conditions were set.
